What if my car insurance claim is denied?

If you’re involved in an auto accident, the next step is to file a claim with your insurance company. Even if you’re fairly certain that you’re not at fault, your insurance provider may believe otherwise. If your claim is denied, The Street recommends taking the following steps.

The first step is to read through your policy terms and conditions in great detail. Most drivers neglect to do this before signing up for a policy and are subsequently surprised that an incident is not covered. There are many variables that can come into play, such as the purpose you're using your vehicle, which may prevent you from being covered. If you find that your policy does cover the accident, the next step is to build a case on your behalf.

It’s always recommended that drivers document the scene of an accident in case a dispute occurs. This entails taking pictures of your vehicle as well as any others involved. Details of the accident may be evident in the types of damage, and photographic proof will build the strongest case. Also, be sure to keep medical records and other documentation of injuries. This will show that you also sustained bodily damage as a result of the accident.

You’ll probably need to speak with an insurance agent at some point, who may request a recorded statement. When doing so, stick to the facts of the case and refrain from including additional information. Even if you don’t admit guilt, your statements could be perceived that way. If your claim continues to be denied, you can also file a grievance with the National Association of Insurance Commissioners.
